KAJIAN PENYELESAIAN SENGKETA TANAH WAKAF DI KOTA MATARAM MELALUI MEDIASI DI LUAR PENGADILAN

Abstract

This research was conducted to determine the resolution of waqf land disputes in Mataram City, a case study in Monjok sub-district, Selaparang sub-district. Waqf is one of the concepts of giving property in Islam. This concept is also based on the concept of alms. Waqf is also a means of developing the community's economy, especially in Indonesia, waqf is really needed to help our brothers and sisters who are on the poverty line. This research uses qualitative research methods. This qualitative research method is used to understand phenomena related to the experiences of research subjects, such as behavior, perceptions, motivations and actions carried out by a person. The results of this research show that the resolution of waqf land disputes in Mataram City, specifically in Monjok sub-district, Selaparang sub-district, Mataram City is by means of deliberation to reach consensus. Settlement of land disputes in Monjok sub-district, Selaparang sub-district, Mataram City is carried out through non-litigation channels, precisely through deliberation activities in resolving problems between the two fikah parties so as to produce an agreement on the status of the land remaining as waqf land.
